Managing the costs and burdens associated with responding to discovery requests is often overwhelming. Compounding cost and effort is the volume of electronically stored information (ESI) that often needs to be collected, reviewed, and produced. When responding to subpoenas in a governmental investigation the entire process is often amplified: timelines are accelerated; negotiation may seem impossible; a mistake may result in obstruction of justice charges.

There are some things you can do. Developing a methodical approach to subpoena response will allow for better understanding, management, and reduction of the costs and burdens imposed on the organization. This process will also better support improved negotiations with the government regarding proper scope and manageable timelines.
