October 28, 2009
Employment Law Alert
Author(s): Tara E. Daub

Under federal law, employers are required to post notices in the workplace advising employees of their rights under federal employment discrimination laws. The Equal Employment Opportunity Commission (“EEOC”) has released a new version of its “Equal Employment Opportunity is the Law” poster, which has been updated to reflect current law, including the addition of information about the Genetic Information Nondiscrimination Act of 2008 (“GINA”), which is effective November 21, 2009.

The EEOC’s revised poster is available in English, Arabic, Chinese, and Spanish. Employers may obtain copies of the new poster at:  http://www.eeoc.gov/posterform.html.

In light of the new posting requirement, employers may also want to add language to their employee handbook policies incorporating the language concerning GINA.
