Experience

Gary Oberstein counsels and represents employers in a broad range of employment-related matters, including employment discrimination, sexual harassment, employee discipline and discharge, employment agreements, handbooks and policy manuals, wage-hour, privacy, drug testing, safety, non-competition agreements, reductions in force, workforce restructuring , and the labor and employment implications of mergers and acquisitions. He also serves as chair of the firm’s Wage-Hour Team.

Mr. Oberstein regularly conducts on-site management and staff training programs concerning workplace sexual harassment and other employment issues. He represents employers in state and federal courts and agencies.

Mr. Oberstein has been recognized for the third consecutive year for exceptional standing in the legal community in Chambers USA: America’s Leading Lawyers for Business 2009 for employment work. Mr. Oberstein lectures extensively on employment law issues and has published several articles on the topic, including “Sexual Harassment in the Health Care Workplace,” “An Employer’s Chart for Navigating the Mine Field of Employee Terminations,” “Self-Publication Defamation in the Employment Context” and “Should Law Firms Put to Pasture Age-Based Mandatory Retirement?”

He has served on the Massachusetts Bar Association’s Labor and Employment Law Section Council, served as chairperson of the Section’s Employee Rights and Responsibilities Committee, chaired the Section’s monthly group discussion series, and has served as liaison of the Labor and Employment Law Section of the Boston Bar Association.
