Our deep bench strength across legal disciplines enables us to identify opportunities, provide innovative solutions, and address the full array of business issues encountered by clients as they design and build sustainable development projects, create and bring to market Cleantech innovations, site and construct renewable energy facilities, and take other steps to respond to the projected effects of climate change and rapidly escalating fuel costs.

We are widely known as the nation’s preeminent firm in structuring and closing investments in tax-credit transactions. We’ve closed deals involving more than $1 billion of wind equity, nearly $1/2 billion of geothermal equity, and the nation’s largest tax credit solar project.. Our public finance lawyers helped develop the legislation that created Clean Renewable Energy Bonds (CREBs). Throughout the U.S., our energy, environmental, project finance, real estate, tax credit syndication, regulatory, and intellectual property teams have given critical assistance to a broad range of innovative renewable energy projects, including wind, solar, fuel cells, biomass, and geothermal. For example:

  • For a national developer, we were engaged to serve as project counsel advising on all financing, interconnection, energy regulatory, permitting, siting, environmental, real estate, and real property tax aspects of a 90 MW wind energy facility.
  • For the largest U.S. photovoltaic project closed to date, Nixon Peabody assisted the client to negotiate and structure the deal, performed due diligence, and rendered tax advice.
  • Nixon Peabody assisted a national investment banking firm to evaluate and acquire equity interests in wind farm portfolios located throughout the U.S.
  • Our Intellectual Property team advised a company founded to commercialize olefin metathesis catalyst technology, a green chemical technology that enables synthesis of chemical compounds at greater efficiency, under less stringent reaction conditions, and with reduced byproducts and hazardous waste.
  • Nixon Peabody helped a national investment banking firm acquire a $153 million interest in a portfolio of geothermal facilities.
