Patent Reform News & ResourcesPatent reform has now moved from being a topic of discussion to a matter of action for both Congress and the U.S. Patent and Trademark Office (USPTO). Patent reform legislation, which had previously taken the form of proposed legislation, was passed by the House of Representatives and is coming up for a vote in the Senate. Alongside Congress’s reform activity, the USPTO has proposed numerous rule packages and now promulgated final rules changing the procedure under which patent applicants file and prosecute their patent applications before the USPTO. Both avenues of reform are fundamentally changing the U.S. patent system. Patent applicants need to be aware of these fundamental changes. This website contains information on Congress’s legislative activity as well as the USPTO’s rulemaking activity to reform the U.S. patent system. While Congress and the USPTO are actively pursuing patent reform, the Supreme Court and the Federal Circuit have been equally active in addressing issues affecting U.S. patents.
