Incidents of sexual misconduct pose vexing challenges for colleges, universities, and secondary schools, particularly with the increase of lawsuits filed by complainants and respondents. Emerging issues include how to evaluate and implement interim measures during the disciplinary process and the best practices to conduct investigations in a prompt and equitable manner. Also, as evidenced by a recent Seventh Circuit ruling, issues relating to transgender students pose evolving Title IX issues.
