Nixon Peabody secures dismissal of transgender locker room policy lawsuit for Planet Fitness

Boston, MA. Nixon Peabody LLP secured a full victory for client Pla-Fit Franchise, LLC (PF Corporate) in the 42nd Circuit Court for the County of Midland (Michigan). The parent company and a Planet Fitness franchisee sought the dismissal of a lawsuit attacking the company’s transgender-friendly locker room policy, calling the suit “woefully deficient” and arguing that the plaintiff’s suit promotes discrimination against transgender people. The Nixon Peabody legal team filed motions for summary disposition claiming that the plaintiff failed to state a claim upon which relief could be granted. Midland County Circuit Court Judge Michael J. Beale found the lawsuit filed by a Michigan woman not legally sufficient to continue.
