Marx P. Calderon is a member of the Complex Commercial Disputes practice group, where he represents public and private companies in connection with business torts, contract disputes, government investigations, FCPA cases and other commercial and financial matters.

Prior to joining Nixon Peabody, Marx was a judicial intern for the Honorable David H. Hennessy, in the United States District Court for the District of Massachusetts.

What do you focus on?

Complex Commercial Litigation

My commercial litigation practice includes helping clients resolve a broad range of commercial disputes, including claims for breach of contract, unfair competition, class action defense, tort claims, intellectual property claims and related litigation. I represent both local and international clients in a variety of industries.

I am involved with all phases of litigation, from the discovery and due diligence processes, to assisting with depositions and trial preparation. By developing a deep understanding of client industries, I am able to ensure cases run smoothly and efficiently in order to maximize value for my clients.

Government Investigations & White Collar Defense

I focus on representing clients through all stages of government investigations initiated by both state and federal agencies, including the U.S. Department of Justice (DOJ), the Securities and Exchange Commission (SEC), and state Attorney General’s Office. My experience includes representing clients in connection with matters involving the Foreign Corrupt Practices Act, Anti-Kickback Statute, the False Claims Act, the Securities Act, the Securities Exchange Act, and federal extortion and bribery laws, among others. I help companies—and company employees—in internal investigations to assess and mitigate risk. I represent clients through all stages of enforcement proceedings, from grand jury proceedings through sentencing and appeals.

What do you see on the horizon?

I see disputes and investigations taking on a more global scale as contracts and transactions become increasingly cross-border.
