Alice Ma is a consultant for Nixon Peabody CWL in Hong Kong. Alice is an experienced commercial, probate and banking litigator with previous work experience as counsel/regulator at Office of the Telecommunications Authority (now Office of the Communications Authority) and Estate Agents Authority.
I focus my practice on commercial and financial litigation, arbitration and mediation; banking, derivative and other investment products litigation; insolvency practice; contentious probate; land disputes; employment, trade description and product liability advice; defamation; professional liabilities; judicial review; competition appeal; disciplinary proceedings and administrative appeal; and art law and advice.
I have represented families in complex contentious probate matters involving declaration of forged will, replacement of executors, recovery of losses caused by executors’ serious breaches of duties. I helped a family collect their fair share of an estate by proceedings and mediation and avoided huge legal bills and bitter battles. I charted strategies for a family to recover money secretly pocketed by executor. I devised strategies to enable a client to take over the administration of her mother’s estate by forcing the wrongdoing executor to step aside.
I have fended off a multimillion financial misrepresentation claim for losses sustained in trading of accumulators, decumulators and equity-linked notes for a major local bank; defended a listed realty group in a claim for non-payment of land premium advanced by a statutory public body; reclaimed possession of a hotel building and recovered a huge mortgage and building loan with full interest and costs for a major local bank; recovered multiple millions paid in a JV investment proposal with ancillary receivers’ appointment and insolvency actions for a listed PRC company; advanced a claim against a reputable securities brokerage for money lost based on bogus equity-linked notes valued in the millions; obtained full recovery for a bank with injunction proceedings on unpaid LC loans. I also defended claims from customers of securities houses and advanced claims for a large number of banks.
I have handled global assets tracking in bankruptcy and winding-up cases, scheme of arrangement for a major motor manufacturer listed on the NY Stock Exchange, arranged section 221 applications against ex-directors of a Hong Kong company with mainland China and U.S. investment with investigation and Chapter 7 bankruptcy proceedings in U.S.; recovered shares and dividends for ex-JV partners of a HK listed company; conducted seminars and advised private clients and social enterprises on Trade Descriptions (Unfair Trade Practices) (Amendment) Ordinance 2012 and Competition Ordinance.
I have advised art galleries and auction houses on consignment, sale and auction of art works.
I also acted for both employers and employees in employment disputes and recovery of losses on breaches of contractual and fiduciary duties and theft of confidential information and data.
Heated contentious probate matters will continue as helmsmen of many wealthy families are not making proper estate planning and inter vivo dispositions. Fraud and hacking offences will further increase and taking urgent and targeted steps to recoup commercial losses is crucial. Competition Ordinance will add a new dimension to the local business and regulatory spheres.
