Dan Valles is counsel in Nixon Peabody’s Labor & Employment practice group, representing clients in all aspects of employment and business-related state and federal litigation.
I focus my practice on three main areas: counseling on domestic and international employment issues, conducting internal investigations and litigation including False Claims Act work.
Much of my time is focused on providing preventative counseling regarding employment issues such as hiring, wage and hour compliance, data privacy, leave policies and procedures, employee agreements, handbook drafting and auditing, workplace compliance investigations and employee terminations.
I handle employment and business-related litigation, including taking and defending depositions; arguing before courts on pre-trial law and motion matters; defending clients before the DLSE, EEOC, DFEH and the EDD; drafting motions for summary judgment; and negotiating settlement agreements.
In addition to wage and hour class action defense, I’ve also represented employers in False Claims Act litigation, commercial contract breaches, misrepresentation and fraud, wrongful termination and retaliatory discharge, employment discrimination and harassment, unlawful and unfair business practices, Americans with Disabilities Act, Disabled Persons Act, Unruh Act, Fair Employment and Housing Act, Age Discrimination in Employment Act, Family Medical Leave Act, California Family Rights Act and state and federal wage and hour disputes.
I’m following emerging employment issues facing companies and investors—
especially in the technology sector and start-up phase—and developing strategies on how they can best position themselves to minimize or avoid potential liability in the new shared economy with an ever changing employment landscape.
