Tom represents clients in contract disputes, trial and appellate litigation and provides strategic and legal compliance counseling. He also advises on employment-related claims, government and internal investigations, white-collar defense, national/cyber security, government contracts, and complex commercial litigation matters. Tom continues to proudly serve in the U.S. Navy Reserves as a Judge Advocate.
Prior to joining Nixon Peabody, I was a judicial clerk to Chief Judge Glenn Suddaby, U.S. District Court, N.D.N.Y., and Justice Bernadette Clark, New York State Supreme Court. I also served eight years on active duty with the Navy as a prosecutor, defense counsel, and principal legal counsel for submarine force and Navy SEAL commands.

I defend clients against employment-related claims in federal and state court litigation and before administrative agencies. My experience includes claims of employment discrimination, retaliation, harassment, actions under the Uniformed Services Employment and Reemployment Rights Act (USERRA), Family Medical Leave Act (FMLA), disability laws, and whistleblower claims. I have also litigated hundreds of contested employment cases in alternate dispute and administrative forums. I leverage my experience as a judicial clerk, defense counsel, and prosecutor to my clients’ advantage.
I have handled a diverse portfolio of government, nonprofit, and private sector investigations, including criminal investigations, internal audits, congressional/legislative inquiries, inspector general reports, equal opportunity complaints, and other internal employment matters. I draw on my experience conducting, supervising, or responding to hundreds of investigations, including some of the Navy’s highest visibility mishap and fraud matters. My clients receive holistic advice as I have handled cases from every vantage point, as a prosecutor, defense counsel, investigator, general counsel, and judicial clerk.

I have spent my career providing clients, senior officers, government officials, and judges with sound, timely, and actionable legal advice. As an advisor and counselor, I help my clients get to a “yes” whenever reasonably possible on issues of employment, corporate governance, risk management, and statutory and regulatory compliance. I get to know my client’s business and translate their legal risk into operational and mission risk.
I focus on a wide variety of commercial disputes, including contracts, purchase agreements, and business-related tort claims. I have experience in all phases of litigation, as well as alternate dispute resolution. I leverage my extensive motion and trial experience in state and federal courts as well as administrative proceedings and courts-martial to the benefit of my clients.
I am no stranger to advising in high-pressure, high-stakes situations. As the primary legal advisor for submarine force and Navy SEAL commands, I regularly advised on national security, operational, and international law and policy issues. This includes experience in cyber security, intelligence law, data collection, data privacy, and data breach response. I also have experience advising on the acquisition and administration of government contracts under the Federal Acquisition Regulation (FAR) and Defense Federal Acquisition Regulation (DFAR) for multi-million-dollar weapon systems, platforms, equipment, and contracted services.
