    Introduction

    Caitlyn Smith is a department attorney in Nixon Peabody’s Litigation practice group. She represents both individuals and entities in a wide variety of disputes and litigation.

    My focus

    My practice focuses on representing clients in all phases of disputes and litigation, from pre-trial motions and discovery to trial-prep, trials, and appeals.

    Looking ahead

    Remote technology may permanently alter the landscape of discovery and trial practice, increasing the importance of developing the skills to be an effective advocate in the virtual arena.

    • Most recently, Caitlyn was a judicial law clerk for the Honorable Chief Justice Paul A. Suttell of the Rhode Island Supreme Court.
    • While in law school, Caitlyn was a judicial extern for Judge O. Rogeriee Thompson of the U.S. Court of Appeals for the First Circuit, and a legal intern at NP.

      Prenatal genetic testing suit bounced by Rhode Island top court

      This article covers a Rhode Island Supreme Court appellate win in favor of client Corning Inc., which faced a lawsuit seeking damages for harm caused by a genetic condition. The court joined an “overwhelming majority” of state courts that have refused to recognize that life, even a life with severe impairments, is a legal injury. The NP team representing Corning includes Construction & Real Estate Litigation practice group leader Jeff Brenner, counsel Bill Wynne, and department attorney Caitlyn Smith, all from the Providence office.

      This article discusses a judge’s dismissal of hostile work environment and disparate treatment claims against the Rhode Island School of Design, finding that the plaintiff’s lawsuit failed to put forth plausible allegations of gender-based discrimination. Providence partner Steven Richard, leader of NP’s Higher Education and Title IX teams, and department attorney Caitlyn Smith, both of the Construction & Real Estate Litigation group, are representing RISD in the case.

      Providence partner and leader of the Higher Education and Title IX teams Steven Richard and department attorney Caitlyn Horbert, both of the Complex Commercial Disputes practice, contributed this article on a much-debated and evolving Title IX question of whether discrimination against a transgender student in an education program or activity constitutes discrimination “on the basis of sex” subject to the statute’s protections.
