Brian P. Donnelly

Brian Donnelly is an experienced litigator who represents companies in a variety of areas, including antitrust, administrative litigation, and complex business disputes. He is active in the firm’s Antitrust, Regulatory and Unfair Trade Practices group and co-chairs the DC office’s Recruiting and Pro Bono committees. A former Marine Corps officer and Iraq War veteran, Brian regularly provides pro bono representation to military veterans and veteran-serving organizations.

What do you focus on?

I help clients manage litigation in service of their broader business goals. I have represented clients in numerous state and federal lawsuits, including several trials. I also handle administrative investigations and provide counseling as part of antitrust and regulatory compliance programs.

Antitrust

I help clients comply with state and federal antitrust laws and defend them in related investigations and litigation. I have represented clients in significant public-company mergers, including Hart-Scott-Rodino filings and extensive second requests. I also provide regular compliance counseling to companies and trade organizations.

Administrative Litigation

I help clients navigate administrative investigations and litigation against state and federal governments. I defend owners and managers of affordable housing projects before HUD and other agencies, as well as in state and federal investigations. I also have extensive experience in the United States Court of Federal Claims helping companies recover energy grant payments from the Department of the Treasury under Section 1603 of the American Recovery and Reinvestment Act of 2009.

Complex Business Disputes

I handle a wide variety of business disputes, including claims for business torts, trade secret violations, breach of fiduciary duties, and breach of contract, among other areas.

What do you see on the horizon?

Antitrust regulators will continue to grapple with the growing prevalence of big data and its effects on competition. Companies must remain attentive to developments in this area as data becomes ever more integral to their businesses. I also see the increased politicization of federal agencies raising the need for companies to seek creative solutions to administrative disputes.

Prior Experience

Prior to law school, Brian served as a public affairs officer in the U.S. Marine Corps and deployed to Iraq in 2006.
