This session will focus on the interplay between recent case law and these trends on campuses, providing a case law update related to Garcetti and its application on campus, as well as Office of Civil Rights Resolution and Settlement Agreements related to issues of free speech. Panelists will provide practical tips regarding:
- How to address professors engaging in political speech and when are faculty speaking on behalf of the institution;
- Defense and indemnity issues, including defamation and the relationship between faculty and student speech;
- Efforts to define policies related to the principles of academic freedom through value statements and the factors to consider in adopting Institutional Neutrality;
- State initiatives that affect the traditional application of Academic Freedom on our campuses, including changes in accreditation.
