    • Leading private equity firm: Serve as healthcare regulatory counsel in ongoing transactions, including the sale of its portfolio company and the purchase of a multi-state DSO, and continuing representation of the DSO on add-on acquisitions

    • Reproductive medicine startup: Assist a men’s health and cryobanking company in regulatory compliance, transactions, GDPR, and HIPAA matters

    Insights in the New Administration's First 100 Days

    • THE WHAT: 
      On February 7, 2025, NIH issued guidance to reduce indirect cost rates to 15% for all NIH research grants, replacing the previous 20-60% rates. Three federal lawsuits led to a nationwide preliminary injunction on March 5, 2025. Recent executive orders also restricted funding for grants with DEI research or language..

      WHY IT MATTERS: 
      Federal guidance is reshaping how medical and research institutions manage funding, affecting grant accessibility, language, legal, business, HR, compliance, and capital resource issues.

    • THE WHAT: 
      On March 15, 2025, Congress extended Medicare coverage for essential non-behavioral and mental health telehealth through September 30, 2025, without geographical limits. COVID-era waivers were also extended, including in-person visit requirements for mental health telehealth reimbursement.

      WHY IT MATTERS:
      Pre-pandemic Medicare telehealth reimbursement rules were waived during the public health emergency. Without confirmation of permanent waivers, providers must prepare for potential restrictions. Other COVID-era waivers, like prescribing controlled substances via telehealth, will expire at year-end without further action.

    • THE WHAT: 
      Recent executive orders on DEI affecting government contractors and grantees could impact healthcare providers who have contracts and grants with federal agencies.

      WHY IT MATTERS: 
      Healthcare providers should assess whether recent executive orders are applicable to them and the impact. Providers should also take measures to ensure their DEI practices and policies comply with longstanding anti-discrimination laws, including Title VII, the Americans with Disabilities Act, and the Age Discrimination in Employment Act, among others.

    • THE WHAT: 
      HHS announced plans for a major restructuring, cutting 20,000 jobs at FDA, CDC, NIH, and CMS. This initiative aims to enhance efficiency and reduce redundancy.

      WHY IT MATTERS: 
      If you are a healthcare stakeholder regulated by HHS, it is important to understand how the restructuring of the Offices of the Secretary and the Operating Divisions may impact you.
