    Energy

The future of energy will look drastically different than it does today. Nixon Peabody works hand-in-hand with energy leaders to navigate and capitalize on the seismic shifts impacting the industry.

    /Overview

The world is driving toward a sustainable future that prioritizes environmental stewardship. The recent legislative push for renewables, including the bipartisan Infrastructure Investment and Jobs Act, has only accelerated this timeline. Transitioning to this new reality won’t be easy. It will require the combined efforts of all leaders in the sector to invest in new approaches to ensure a clean, efficient, and economically viable energy ecosystem. Nixon Peabody can guide you on this journey. Our energy experience is widespread, including wind, solar, geothermal, waste-to-energy/waste-product, biofuel, and hydroelectric issues, among others.  We have counseled power authorities on billion-dollar green bond transactions; we have defended renewable energy companies, ensuring their right to operate; and we have represented utility providers in landmark litigation disputes. Our team has the right experience to counsel our clients as they shape the future of the energy landscape.

    /Representative Experience

    • BlueGreen Holding, LLC: Closing of its North American retail energy sales business, through the sale of 100% of the membership interest of XOOM Energy Global Holdings, LLC to NRG Retail LLC, a wholly owned subsidiary of NRG Energy, Inc.
    • Cricket Valley Energy Center, LLC: Sale of equity interests in the $1.584 billion Cricket Valley Energy Center, a fully-permitted approximately 1,100 MW combined-cycle natural gas electric generating facility located in Dover, New York.
    • ENGIE North America Inc.: Acquisition of all of the equity of Conti Service Corporation, ION Electric, LLC, Indicon Corporation and thirteen of their subsidiaries.
    • Contractor to a major American investor-owned gas and electric utility: Defense of property damage, insurance subrogation, resource loss, and fire suppression claims arising from major wildfires in California and other parts of the United States.
    • Energy services manufacturer: Represented in a high-profile dispute concerning more than 600 punch list items in a $32M energy performance contract involving 40 municipal and school buildings.
    • Solar project contractor: Led a six-week, multi-party arbitration to determine financial responsibility for a $60 million+ overrun on a solar project. We defended the project’s contractor against claims, exceeding $100 million, brought by the project’s owner.
    • Worked with prominent energy companies in multi-million-dollar contract disputes permitting proceedings and environmental compliance matters.
    • Worked with several solar and renewables companies with respect to chapter 11 bankruptcy proceedings.
