All U.S. employers are required to verify the identity and employment authorization of new hires using Form I-9, Employment Eligibility Verification. Failure to do so can result in fines or penalties. The current Form I-9, issued by U.S. Citizenship and Immigration Services (USCIS), indicates an expiration date of August 31, 2019 and USCIS has not yet issued a new Form I-9. However, USCIS announced on August 27, 2019, that, until further notice, employers can continue to use the current Form I-9 even after the expiration date of August 31 has passed. There is no indication of when USCIS intends to issue the new Form I-9. Employers should continue to monitor this to make sure they move to the new Form I-9 in a timely manner once it is issued.
