    Introduction

    Kate Letcher is counsel in Nixon Peabody’s Complex Commercial Disputes practice group. She is a courtroom lawyer who represents individuals and entities in a wide variety of matters, including business disputes and healthcare litigation.

    /My focus

    I represent clients from a diverse range of industries in a variety of litigation matters in state and federal courts and arbitration. 

    COMMERCIAL LITIGATION

    I have significant experience handling complex commercial disputes and representing parties in lawsuits alleging business torts, fraud, and statutory claims. I have also represented clients and individuals in trade secret litigation involving breach of non-compete agreements.

    HEALTHCARE LITIGATION

    I regularly advise healthcare companies in connection with lawsuits, disputes, and subpoenas. I have experience defending and prosecuting claims on behalf of healthcare companies in lawsuits alleging contractual breaches and statutory violations.>

    I also have experience defending medical device manufacturers in product liability lawsuits.

    COLLEGIATE SPORTS EXPERIENCE

    I have experience representing NCAA head coaches in cases involving head coach control violations and recruiting violations.

    ALTERNATIVE DISPUTE RESOLUTION

    My experience in conflict resolution includes representing clients in alternative dispute resolution formats such as mediation and arbitration. I was recently part of an arbitration team that successfully defeated breach of contract and quasi-contract claims where the opposing party sought in excess of $300 million in damages.

    I have also served as trial counsel—including handling opening and closing argument—for a pharmaceutical manufacturer in two complex AAA arbitrations involving disputes with customers. In one, the arbitrator awarded our client the full amount of its claim, exceeding $2.7 million, as well as a discretionary award of attorneys’ fees and costs. In the other, the arbitrator ruled that the customer was not entitled to any damages on its $14 million breach of contract claim and that our client was entitled to approximately $250,000 in unpaid invoices, plus interest.

    Prior Experience

    I am a former judicial extern for the Honorable Daniel P. Brennan, Cook County, Chancery Division, and a prosecutor/law clerk for Chicago Public Schools. Before joining NP, I was a litigation associate at two other law firms in Chicago.

    I am following the evolving policies and laws pertaining to NCAA student athletes’ ability to be paid for their names, images, and likenesses (NIL).

      NP thought leadership in leading journal

      This industry journal, which covers the latest legal issues involving cybersecurity and data privacy, includes two NP articles based on client alerts. Complex Disputes practice group leader John Ruskusky, partners Rich Tilghman and Laura Bacon, and associate Kate Letcher, all in Chicago, contributed an article entitled, “The Seventh Circuit certifies question regarding accrual of BIPA claims to Illinois Supreme Court.” John and Rich also contributed a second article, “Workers’ Compensation Act does not bar claims under the Illinois Biometric Information Privacy Act, Illinois Supreme Court rules.” Both pieces provide insight on the Illinois Biometric Information Privacy Act and its litigation impacts to date.
