    Introduction

    Martha Medina is an associate in Nixon Peabody’s Complex Disputes practice group. She represents individuals and entities in a wide variety of civil matters with a particular focus on disputes with federal agencies.

    /My focus

    ANTITRUST

    I represent clients in civil antitrust investigations and transactions subject to federal and state government agency review. My practice includes representing clients in investigations, including Second Request merger investigations and responding to subpoenas and Civil Investigative Demands (CIDs) issued by the Federal Trade Commission and Department of Justice. I assist clients throughout the Hart-Scott-Rodino (HSR) Act filing process and advise clients on related reportability issues. 
    I work with clients to analyze and mitigate potential risks and ensure compliance with federal and state antitrust laws by conducting internal compliance audits and providing antitrust training.

    DISPUTE RESOLUTION, COUNSELING, AND LITIGATION

    I assist clients in all phases of litigation, including negotiating pre-litigation disputes through mediation. I represent clients from a diverse range of industries and a variety of complex civil litigation matters, including contracts, trusts, housing, and other real estate disputes in both state and federal courts. I have successfully resolved fair housing and discrimination-related complaints against companies in federal court and administrative complaints before the US Department of Housing and Urban Development (HUD). Relatedly, I routinely advise clients in developing policies to comply with fair housing and antidiscrimination laws (including the Fair Housing Act, Americans with Disabilities Act, and the Rehabilitation Act).

    In addition to my commercial litigation practice, I represent pro bono clients in various civil rights and immigration proceedings.

    I previously served as a judicial intern for the Honorable Emmet G. Sullivan of the US District Court for the District of Columbia.

    /Representative experience

    • Successful defense in FTC second request investigation of SAES Getters, S.p.A., in sale of medical nitinol business to Resonetics, LLC (2023)
    • Successfully obtained dismissal of detinue action against client in Maryland state court (2021)
    • Obtained directed verdict in jury trial on claims involving multi-million dollar claims of securities fraud, fraud, and breach of contract, among other claims in the US District Court for the District of Maryland (2021)
    • Obtained favorable settlement, including systemic policy changes and a written apology for client, in racial bias and unlawful seizure case (2021)

    /Looking ahead

    Companies and consumers alike must be aware of the risks associated with their private data given the heightened exposure to litigation and increased regulatory enforcement related to privacy, tort, and cybersecurity issues.
