Shawntel is an associate in Nixon Peabody’s Private Clients Group and a member of the International Private Clients Team. Shawntel’s practice includes estate planning (including trust administration) and tax planning for individuals and families both in the U.S. and around the world.
I assist individuals and families in the U.S. and abroad with structuring comprehensive estate plans that ensure the client’s objectives are met for generations to come while taking into consideration multijurisdictional succession, tax, and reporting concerns.
In addition to advising U.S.–based domestic clients, I advise non–U.S. persons with U.S. connections, U.S. persons living abroad, and U.S. persons with foreign investments, on the myriad of U.S. tax and reporting regimes, including U.S. federal income and transfer taxes, as well as foreign entity reporting and taxation (PFICs and CFCs), FIRPTA, and FATCA.
I use my previous experience at a Swiss trust company to help clients structure and administer trusts and underlying holding structures in the most efficient and practical manner, while at the same time providing sophisticated guidance regarding any tax and reporting implications.
The increase in enforcement of U.S. information reporting such as FATCA and foreign trust reporting (Form 3520) will greatly affect families with U.S. connections, whether it be trust beneficiaries that are U.S. persons or investments in the U.S. In addition to considering tax and succession issues when structuring an estate plan, families will need to consider and plan for what information is required to be disclosed and to whom.
