Since its enactment as part of the Infrastructure Investment and Jobs Act, BABA has required that iron, steel, manufactured products, and construction materials used in federally assisted infrastructure projects be produced in the United States. The requirement reaches recipients, subrecipients, contractors, and suppliers at every tier.
This two-part webinar series, presented by Cara Wulf, Partner at Nixon Peabody, gives participants a working command of BABA in two 60-minute sessions. In this series, we will cover the foundational concepts of BABA, including what the statute requires and how OMB and federal agencies have implemented it, including 2 CFR Part 184 and OMB M-24-02. We will also cover how to manage the practical application of BABA, to include building and defending waiver requests, comparing how agencies are applying the requirements, and setting up contracting and supply chain controls that hold up in an audit.
