
Introduction
Aaron Brian is an experienced advisor and trial attorney whose approach to solving disputes, as well as his client base, is a mix of art and science. He works with artists, collectors, galleries, and museums on legal issues involving the sale, acquisition, inheritance, provenance, and authenticity of artworks. Teaming up with the firm’s national healthcare litigation team, Aaron also advises hospitals and healthcare providers on high-stakes disputes. Aaron’s industry knowledge and analytical framework fuel his strong track record of resolving complex litigation.

Art Industry Practice
I represent a variety of participants in the art industry including artists, galleries, collectors, museums and institutions, and foreign sovereigns. My clients rely on my experience and advice concerning contracts, purchase and sale agreements, intellectual property and licensing, restitution claims, ownership disputes and the authenticity of high value artworks. A significant portion of my work for art industry clients is helping to resolve legal disputes, both through pre-litigation discussions and negotiations and formal actions. I have tried cases in state and federal court, and am actively involved in appeals across different jurisdictions. I leverage this experience and skillset to develop tailored strategies that meet the specific needs of my clients and effectively resolve issues as they arise.
Healthcare Litigation
As part of the firm’s national healthcare litigation practice, I represent hospitals, healthcare providers, and risk-bearing organizations in disputes, arbitration, and litigation encompassing payor-provider disputes, continuing care obligations under state law, reimbursement claims, breach of professional service agreements, and untangling failed partnerships. I work on claims filed in court and arbitration, and work closely with clients to develop effective strategies to achieve the desired outcome based on the particular dispute and the relevant evidence and governing law.
Intellectual Property
My clients include individuals and companies across the spectrum, from up-and-coming writers and artists to established podcast companies, musicians, and importers. I work closely with these clients to protect and monetize their IP rights, including copyright, trademark, and patent protection, enforcing IP rights with cease and desist letters, and advising on licensing issues. I have a strong track record of resolving disputes through litigation, including disputes over ownership, infringement, licensing, misappropriation, and even theft of IP.

- Won a federal bench trial for foreign museum concerning ownership of a painting; the US Supreme Court heard this case in January 2022
- Successfully represented art collector in claim against art dealership for unlawful use of client’s funds

- Co-chaired federal copyright trial on behalf of large clothing retailer that dealt with numerous novel issues and resulted in significant post-trial relief; the US Supreme Court heard this case in November 2021
