
Introduction
Leigh Gilligan represents clients on environmental and land use matters, focusing on licensing and permitting, compliance counseling; and advice about the environmental aspects of business, lending, and real estate transactions.
My focus
I focus my practice on environmental and land use matters. I represent parties involved in federal and state hazardous waste sites in connection with remediation planning and implementation; liability analysis, allocation, and negotiation; environmental insurance; and acquisition and divestment advice, negotiation and strategy, including due diligence activities. I also focus my practice on environmentally related permitting and licensing in connection with real estate development, including compliance with the Massachusetts Environmental Policy Act and legal requirements related to wetlands, tidelands, air, water, and traffic/transportation. I work with clients on environmental compliance counseling and frequently assist with environmental review and document review/negotiation in connection with business, lending and real estate transactions of many types and sizes.
Specifically, I regularly represent both borrowers and lenders in evaluating, managing, and resolving environmental issues, including preparing and/or reviewing environmental evaluations related to loans and bond issuances. I have extensive experience in addressing environmental issues involved in the purchase and sale of property and businesses, including confirming and securing liability protections and economic incentives for brownfields development.
Looking ahead
The real estate market and the regulatory world are both in transition, as they often are. Attorneys need to team with clients to stay informed and ahead of both market and legal changes that affect project planning and implementation.
