Introduction
Alec is an associate in Nixon Peabody’s Intellectual Property practice group. He is an experienced patent litigator who has handled numerous cases in federal court and before the US Patent and Trademark Office (USPTO).
My focus
With a background in engineering, I assist clients with patent-related issues in a wide range of technology areas, including consumer electronics, software solutions, cloud networking solutions, network security, telecommunications, electrical wiring and componentry, lighting, renewable energy solutions, and data center operations.
My practice focuses primarily on patent disputes, with an emphasis on US district court litigation and inter partes review proceedings (IPRs) before the Patent Trial and Appeal Board (PTAB) of the USPTO. I am experienced in providing my clients with technical and legal analysis, conducting diligence and fact development, working with experts and witnesses, taking and defending depositions and live testimony, preparing and arguing motions, and managing the day-to-day efforts of trial teams.
In addition to defending clients in litigation, I assist clients with preparing and prosecuting patent applications before the USPTO, conducting validity and infringement investigations, and coordinating licensing negotiations.
I also have significant experience at the United States Court of Appeals for the Federal Circuit, where I previously served as a judicial intern for the Honorable Judge Kathleen M. O'Malley.
Looking ahead
Strong patent rights are valuable in competitive and crowded industries. The implementation of a robust patent strategy, including developing a comprehensive patent portfolio and strategically enforcing and licensing those rights, can help set companies apart from their competitors, provide a significant source of revenue, and ensure growth and stability.

Full Federal Circuit urged to set tighter rules on patent damages
Nov 27, 2024This article covers a total of 18 amicus briefs filed this week in EcoFactor Inc. v. Google LLC, asking the Federal Circuit to rule that district judges must carefully scrutinize expert testimony seeking large damages in patent cases and exclude unreliable opinions, rather than allowing juries to decide how much weight to give them. The article mentions NP for filing an amicus brief on behalf of the Licensing Executives Society. The team includes Chicago partner Dan Stringfield and counsel Matt Zuziak, and Albany associate Alec Royka, all of the Intellectual Property practice.
