Researchers, startups, and pharmaceutical companies are seeking to develop and patent microbiome-related innovations more often than ever before. In 2025, the US Patent and Trademark Office issued 82 such patents; 38 (or 46%) were for consumer-facing products, such as dietary supplements, cosmetic formulations, oral care products, digital health devices, and pet health compositions. Microbiome innovation is moving beyond drugs and clinical interventions into everyday consumer products.
In a shift from previous years, patent seekers are clearly focused on the average shopper. Why is this shift happening? How does it manifest across different product categories? And what does it tell us about emerging claim refinement strategies?
What’s driving the shift toward consumer microbiome patents?
Several forces are converging to fuel this shift—most notably, the slow pace of securing patents in the pharmaceutical microbiome space. Established prior art raises barriers to broad therapeutic claims, and regulatory complexity makes for long approval timelines.
By contrast, consumer channels offer larger markets and faster paths to commercialization. Unlike a new pharmaceutical, a dietary supplement or cosmetic product can reach consumers without a full clinical trial. (Though regulatory agencies, such as the US Food and Drug Administration, typically require that such goods include a disclaimer that any health claims have not been evaluated and that the goods do not treat disease.)
As this field matures, patent claims become narrower and lend themselves to consumer-focused, product-specific framing rather than to broader therapeutic impact.
However, the shift is not solely a response to constraints. The increase in consumer-oriented claims suggests the microbiome has entered mainstream consciousness as something real and relevant to daily life. Applicants have recognized this. Many patents in this set include both therapeutic and consumer claims within the same patent, reflecting a deliberate multi-pathway portfolio design rather than a retreat from pharmaceutical ambition.
The pharmaceutical-to-consumer continuum in microbiome patents
There is no bright line separating therapeutic and consumer patent claims; rather, they are best understood as distant points on a continuum of potential outcomes. Therapeutic framing employs descriptors, such as “treat” or “therapeutically effective amount,” and names the diseases an innovation is designed to treat. Of course, such methods cannot be practiced until regulatory approval is obtained in the specific jurisdiction.
Consumer framing often uses “promote,” “support,” “improve,” “maintain,” and “reduce likelihood” in conjunction with outcomes of general physiological maintenance or risk reduction. Some patents deploy both framings across different independent claims, positioning simultaneously for pharmaceutical and consumer pathways.
The dataset also offers instructive borderline cases.
- US Patent No. 12,186,352 claims “a method for treating autoimmune and/or inflammatory disease” through a fasting-mimicking diet combined with a probiotic composition. The indication is clinical, but the modality is consumer-facing.
- US Patent No. 12,472,211 splits the difference within a single patent, with one independent claim using the consumer-friendly language of wellness (“improving or restoring the flora and/or microbiota of the respiratory tract and skin”) and another directed toward treating a group of specific diseases.
- US Patent No. 12,194,142 recites treatment of “gastrointestinal irregularity” using a deposited Bacillus subtilis strain at defined colony-forming unit (CFU) doses, reading commercially like an over-the-counter probiotic despite its “treat” language.
- US Patent No. 12,246,078 claims a multi-step oral hygiene regimen using mouthwash, oral strips, and toothpaste with zinc and xylitol to “reduce likelihood of P. gingivalis infection.” The endpoint sounds clinical, but the product forms and consumer instructions (e.g., “brushing,” “swishing,” “spitting”) are unambiguously directed to promoting gum or oral health.
Of the 38 consumer-oriented patents described above, 17 are unambiguously consumer-facing (cosmetic, oral care, over-the-counter supplement, consumer kit/app, pet product, or consumer article without disease-treatment framing). The other 21 are on the borderline—feasible for consumer channels but using clinical language. The coexistence of both groups suggests that the blurred boundary between pharmaceutical and consumer uses is likely a deliberate portfolio design. And we believe this is where the most commercially flexible microbiome IP lives.
Microbiome consumer patents span at least nine product domains
Consumer-oriented claims in the set span at least nine identifiable product domains. Individual patents may appear in more than one category because a single patent can target multiple consumer applications through different claims, underscoring the versatility of microbiome science as a platform technology.
- Gut Health Supplements and Wellness (17/82; 20.7%) is the largest single consumer category, spanning single-strain probiotics, multi-species blends, non-living derivatives, phage-based formulations, and botanical hybrids. Examples include a colonic-release oral tablet of turmeric, pomegranate, and Boswellia extracts in an alginate/hydroxypropylmethylcellulose (HPMC) matrix (US Patent No. 12,285,035); a probiotic blend defined by family-level percentage floors (US Patent No. 12,305,215); and an autobiotic composition, which can be in a dual-chamber capsule configured to release prebiotic in the stomach and postbiotic in the large intestine (US Patent No. 12,472,200).
- Skin and Personal Care (7/82; 8.5%) ranges from methods of treating or preventing dermatological conditions using topical postbiotics produced by two-stage fermentation (US Patent No. 12,324,820) to methods of promoting the growth of S. epidermidis using compositions with defined carbon/nitrogen sources and triglycerides (US Patent No. 12,447,121) and emulsions, combining prebiotic, peptide, antioxidant, and matrix metalloproteinase (MMP) inhibitor components (US Patent No. 12,502,346). These claims mirror conventional cosmetics in product form but are directed to microbiome-directed mechanisms.
- Women’s Health (5/82; 6.1%) includes vaginal probiotic compositions with ATCC-deposited Lactobacillus strains in glassy matrix, PBV, or lyophilized forms for vaginal, oral, or rectal delivery (US Patent No. 12,370,228); topical prebiotic compositions that synergistically promote L. crispatus relative to E. coli (US Patent No. 12,419,898); and a primer-based kit for assessing vaginal microbiome health (US Patent No. 12,509,734).
- Consumer Diagnostics and Digital Health (4/82; 4.9%) features system, method, and computer-readable medium claims that culminate in consumer-facing actions. US Patent No. 12,437,877 is illustrative: a computer-implemented method that accesses gut metagenomics data, determines weight-loss potential based on microbial replication rates, and, upon finding that potential above a threshold, administers “a treatment for the subject, wherein the treatment includes a probiotic supplement or a prebiotic fiber supplement.” The endpoint of the analytical pipeline is a consumer supplement recommendation. These patents illustrate a broader convergence of AI and microbiome science that is increasingly visible in the diagnostic space, which we will examine in detail in a future article.
- Pet and Companion Animal Health (3/82; 3.7%) includes synthetic oligosaccharide nutrition for gastrointestinal barrier dysfunction (US Patent No. 12,251,391 [ID 18]) and vitamin-based delayed-release formulations for pet gut health (US Patent No. 12,508,280 [ID 82]).
- Oral Care and Dental Hygiene (2/82; 2.4%) features stepwise consumer-use methods specifying product forms (e.g., toothpaste, mouthwash, oral strips), active ingredients (e.g., menaquinone-7, ubiquinone, zinc, xylitol), and literal consumer instructions such as brushing, swishing, and spitting (US Patent No. 12,246,078 [ID 15]; US Patent No. 12,318,377 [ID 33]).
- Infant and Early-Life Nutrition (1/82; 1.2%) includes methods comprising administering a synthetic composition with 2’-fucosyllactose for infants that increases kynurenic acid production by microbiota (US Patent No. 12,257,259 [ID 21]).
- Functional Foods (1/82; 1.2%) includes edible plants enriched with probiotic bacteria capable of inhabiting the gastrointestinal tract and withstanding surface sterilization (US Patent No. 12,426,616 [ID 60]).
- Consumer Articles and Devices (1/82; 1.2%) features the single article-of-manufacture in this dataset. US Patent No. 12,490,738 [ID 76] claims an exercise, fitness, or yoga mat embedding live non-pathogenic bacteria, bacterial endospores, and/or fungi configured to manipulate the microbiome of the adjacent environment. Its dependent claims add dormancy with activation by moisture, heat, or pressure; scent release; light emission; and dispersal by spraying, coating, or printing. Microbiome IP has moved beyond ingestibles and topicals into the objects people use daily.
The remaining consumer-oriented patents form a smaller but revealing long tail. Beyond the major domains discussed above, the dataset also includes pet and companion-animal health, oral care, infant and early-life nutrition, functional foods, and even consumer articles. The examples are limited in each category, but collectively they show that microbiome-oriented claims are beginning to appear across ordinary consumer settings, from toothpaste and infant nutrition to probiotic plants and microbiome-enabled exercise mats (e.g., US Patent Nos. 12,251,391, 12,246,078, 12,257,259, 12,426,616, and 12,490,738). Taken together, these products demonstrate that microbiome IP is diversifying beyond ingestibles and topicals into a wider range of consumer products, including objects people use daily.
How microbiome patent claims are structured for consumer products
The claim refinement toolkit that we previously wrote about operates with equal sophistication in consumer-oriented patents, where narrowing strategies serve prosecution, product differentiation, and commercial enforceability simultaneously.
Deposit-anchored identity appears in the vaginal probiotic of US Patent No. 12,370,228 (ATCC deposits for three Lactobacillus strains), the phage nutraceutical of US Patent No. 12,419,313 (ATCC-deposited bacteriophages with average nucleotide identity (ANI)-based breadth extension), and the lyophilized Pediococcus acidilactici of US Patent No. 12,491,219 (DSM 32372).
Delivery and formulation constraints in consumer-oriented claims often define the product itself. For example, US Patent No. 12,419,313 formulates its phage composition as a lyophilized or spray-dried powder, enteric capsule, or syrup. US Patent No. 12,370,228 preserves its vaginal Lactobacillus composition in a glassy matrix by preservation, by vaporization (PBV), or by lyophilization and formulates it for vaginal, oral, or rectal delivery. In each case, the formulation constraint is not merely a claim limitation but the architecture of the commercial product.
Quantitative and measurable specifications appear throughout the consumer set, functioning simultaneously as claim limitations and as potential product-level anchors for labeling, quality control (QC), and enforceability. US Patent No. 12,305,215 recites family-level percentage floors (Lachnospiraceae at least 40%, Eubacteriaceae at least 2%, Coriobacteriaceae at least 3%, Lactobacillaceae at least 7%). US Patent No. 12,318,411 requires at least three genetically synergistic L. crispatus strains, for example, that can maintain vaginal pH below 4.5. US Patent No. 12,194,142 defines CFU dose windows for its deposited Bacillus subtilis strain. US Patent No. 12,370,220 requires defined short-chain fatty acid (SCFA) ratios and moisture content below 8%. US Patent No. 12,419,898 specifies a synergy threshold of greater than about 30 for promoting L. crispatus growth relative to E. coli. These are the kind of specifications a QC laboratory can verify and a product label can communicate, subject to any FDA-required disclaimers.
A consumer-oriented phage claim
One patent warrants extended attention for what it represents about the field’s trajectory. US Patent No. 12,419,313 claims: “A dietary supplement and/or nutraceutical composition comprising one or more of an isolated bacteriophage CJLB-4 deposited under ATCC Deposit Accession No. PTA-126839, CJLB-5 deposited under ATCC Deposit Accession No. PTA-126840, CJLB-7 deposited under ATCC Deposit Accession No. PTA-126841, CJLB-10 deposited under ATCC Deposit Accession No. PTA-126842, CJLB-12 deposited under ATCC Deposit Accession No. PTA-126843, CJLB-13 deposited under ATCC Deposit Accession PTA-126844, CJLB-14 deposited under ATCC Deposit Accession PTA-126845, CJLB-15 deposited under ATCC Deposit Accession PTA-126846, or a combination thereof, or variants of said bacteriophage which have average nucleotide identity over genome of ≥99.9% relative to said bacteriophage, said variants having lytic activity against Campylobacter species or strains, wherein the dietary supplement and/or nutraceutical composition is formulated as a lyophilized or spray-dried powder, an enteric capsule, or a syrup.”
This claim uses deposit anchoring and ANI-based breadth extension to define the phage with precision, while preserving meaningful scope, including through a separate independent claim with a ≥95% ANI threshold. The same claim then presents the phage composition in consumer-familiar dosage forms: lyophilized or spray-dried powder, enteric capsule, or syrup. The result is an unconventional biologic presented in conventional supplement and nutraceutical packaging.
What the consumer shift means for microbiome IP strategy
Many microbiome interventions sit at the boundary of wellness and medicine, and the patent landscape reflects this by protecting the same underlying science across multiple commercial pathways. For practitioners, this means building microbiome IP requires the same precision and data-rich disclosures described in our earlier piece, and a strategic awareness of which commercial pathway each claim is designed to serve. The dataset’s breadth of consumer domains suggests that the field has far more room to innovate in consumer products than current portfolios have yet explored. Consumer orientation is a defining feature of where microbiome IP strategy is heading.
