My focus
I possess broad experience in navigating ERISA class actions involving fees, fund performance, and allocations of 401(k) forfeitures.
I assist clients in responding to subpoenas and Section 104(b)(4) requests regarding 401(k) retirement plans, and defend clients against allegations of breaches of fiduciary duty, excessive fees, and fund mismanagement. I also closely follow ERISA class action dockets nationwide and across a broad range of claims to stay on the forefront of what clients should know about ERISA litigation to stay proactive instead of reactive. Additionally, I regularly exchange knowledge with Nixon Peabody’s Employee Benefits and Executive Compensation team to tap into our range of expertise.
I leverage my experience with complex trial and appellate litigation, as well as responding to government investigations, to be a formidable advocate for my clients. I am also a passionate pro bono advocate for landlord-tenant and breach of contract disputes in the District of Columbia.
Looking ahead
With dozens of claims regarding 401(k) forfeiture allocations filed in recent years, district courts and plan sponsors alike anticipate the first appellate decisions.
