    Introduction

    Aldo Ibarra is a litigator and trial attorney who represents clients in complex commercial disputes including construction, high stakes environmental tort, wildfire litigation, financial services disputes, and personal injury litigation. Aldo is also experienced in international arbitration.

    My focus

    Construction

    I represent owners, general contractors, subcontractors, and public entities in all aspects of construction litigation. I help our clients with pre-litigation strategy, from the bidding process, to investigation of claims, and mechanic’s liens. I enjoy partnering with our clients to assess early solutions and help them negotiate out of, or in the context of, mediation. In litigation, I help our clients navigate the discovery process, identify and work with experts, and successfully take matters to trial.

    • Represented a subcontractor and material provider in a complex arbitration proceeding involving claims for breach of contract and negligence in the construction of a baseball field. Defended claims by owner, general contractor, and other subcontractors and obtained award with net recovery in client’s favor.
    • Represented public works general contractor in an action brought by a subcontractor involving claims for breach of contract, negligence, fraud, and early termination. Successfully defended against Plaintiff’s claims and obtained judgment and net recovery, including substantial attorney’s fees and costs, in client’s favor.
    • Represented contractor in action brought by subcontractor for alleged breach of contract in connection with series of projects involving cold in place asphalt recycling. Obtained favorable resolution for client.
    • Represented residential owner in multimillion construction defect and breach of contract arbitration brought against general contractor, which involved claims for construction defect.  Successfully obtained net recovery award for client.

    Complex Commercial Disputes

    My practice is also focused on assisting clients navigate a variety of complex commercial disputes, including wildfire litigation, high stakes environmental tort, financial services disputes, and personal injury actions. I also help loan servicers in connection with the recovery of bank loans, and am a member of our international arbitration practice group.

    • Represented loan receiver in action against borrower in action for real estate loan repayment in California state court jury trial. Obtained multimillion dollar verdict on motion for judgment at close of defendant’s evidence.
    • Represented a Canadian wireless communications designer and manufacturer company against a Taiwanese multinational manufacturer in a contractual arbitration dispute in California.
    • Defended investor in action against software and hardware company involving disgorgement and breach of contract claims. Obtained judgment in client’s favor and successfully assisted in collection efforts.
    • Defended client against indemnity claims related to major wildfires in California, and other states.  Assisted in the investigation of facts, identification of experts, and strategy to defend such claims.
    • Defended clients in several high stakes, complex, personal injury actions and obtained favorable resolution.
    • Served as a deputy district attorney for the Marin County District Attorney handling numerous jury and bench trials.

    Looking ahead

    Wildfire activity is impacting California residents and businesses at a legislative, regulatory, and insurance level. Further, new technologies, such as 3D printers, drones, and AI are disrupting the construction industry.
