    We have extensive experience guiding clients through complex proceedings challenging issued patents before the Patent Trial and Appeal Board.

    /Overview

    Nixon Peabody’s Intellectual Property practice group regularly handles post-grant proceedings before the US Patent and Trademark Office’s Patent Trial and Appeal Board (PTAB), including inter partes review (IPR), post-grant review (PGR), and ex parte reexamination proceedings.

    Our team of attorneys, patent agents, and technical specialists offers deep experience across a wide breadth of industries and technologies—informing our offensive and defensive strategies surrounding validity.

    Our patent litigators and patent prosecutors have been involved in more than 200 post-grant review proceedings and handle these matters in an efficient, cost-effective manner that aligns with the evolving needs of our clients.

    /Representative experience

    • Workspot, Inc.: Represented the enterprise software provider in several IPRs relating to remote application access using virtual machine technology.
    • Solmetex, LLC: Defended the dentistry water solutions provider in a post-grant review petition filed by Dental Recycling North America (DRNA), persuading the PTAB to deny DRNA’s petition at the institution stage.
    • G.W. Aru, LLC: Successfully represented a provider of technologies and services for the petroleum refining and petrochemical industries in securing the denial of an IPR proceeding related to its patent for CO to CO2 combustion promoters.
    • MemoryWeb, LLC: Representing the photo management technology company in multiple IPRs and PGRs filed by Apple, Samsung, and Unified Patents.
    • OneD Material LLC: Successfully invalidated multiple patent claims in an IPR targeting the developer of advanced lithium-ion batteries.
    • Ramot at Tel Aviv University: Representing the university’s technology transfer company in multiple ex parte reexaminations filed by Cisco Systems.
