    Introduction

    Tara Eyer Daub is a litigation attorney in Nixon Peabody’s Labor & Employment group. In her practice, Tara represents employers in trial and appellate court litigation, governmental investigations, traditional labor law issues including labor contract bargaining and disputes, and providing strategic and legal compliance counseling to employers relating to workforce decisions and policies for both union and non-union employers. In addition to national and international companies, she represents nonprofit employers, including hospitals, institutions of higher education, and private schools.

    /My focus

    Employment Litigation

    I defend clients against employment-related claims of all types in federal and state court litigation, and before various administrative agencies, including the Equal Employment Opportunity Commission, United States Department of Labor, and National Labor Relations Board (NLRB). My experience includes defending claims of employment discrimination, harassment, and retaliation; actions under the FMLA and disability laws; whistleblower claims; independent contractor misclassification claims; wage-hour collective and class actions; and breach of contract and restrictive covenant actions. I also represent employers in arbitrations in various forums.

    Labor Relations

    My traditional labor law practice involves representing and advising employers in bargaining with unions, National Labor Relations Act compliance, labor contract administration, grievance and arbitration on discipline and contract interpretation issues, strategic planning, mergers and acquisitions, and management training. This includes representing clients before the NLRB in union representation proceedings and unfair labor practice charges.

    Strategic and Compliance Counseling

    Drawing on my litigation experience, I help clients develop compliance strategies to avoid litigation and agency enforcement proceedings. I advise and counsel employers on a variety of labor and employment law subjects, including employee discipline and discharge decisions; complaints of sexual and other types of harassment; managing complex leave of absence and disability-related issues; wage-hour issues, including overtime and payroll practices; workforce structuring decisions, including WARN Act compliance; and labor relations. This includes compliance advice on the complex federal, state, and local employment laws that govern these issues. I work closely with employers to develop and review personnel policies and conduct training sessions for managers and employees at all levels. I also conduct internal investigations of complaints of sexual and other types of harassment.

    /Looking ahead

    Employers will continue to need innovative strategies for successfully managing their workforces in a climate of rapid change. I help employers find solutions.
